Review of National Employment Standards

Further submissions have been made in relation to the review of the National Employment Standards.

In addition to the call for increased annual leave and personal leave, the ACTU has submitted that there should be a new legal obligation for employers to consult employees before introducing Artificial Intelligence (AI) that tracks an employee’s performance or results in changes to job descriptions.

The Australian Services Union has also submitted that there be AI consultation requirements, and proposed extending paid notice periods to at least six months for workers whose roles are displaced by AI.

Other parties have called for changes to the redundancy provisions, requiring small businesses to make redundancy payments (currently excluded), and removing the drop-off that occurs after 9 years employment (at 9 years an employee would receive 16 weeks redundancy, after 10 years this drops to 12 weeks redundancy).

We will keep you advised of any changes that do occur.
